The US Supreme Court has ruled that Customs and Border Protection (CBP) officers can detain green card holders returning to the US if they have pending criminal charges, without first establishing probable cause or meeting the strict legal standard previously required. The decision shifts enforcement power toward border agents and away from the courts.

This affects permanent residents who travel abroad and plan to return. If you hold a green card and have any pending charges—even misdemeanors—you now face a higher risk of detention and questioning at the border. CBP can use parole authority to hold you while determining admissibility, rather than being required to prove you're a flight risk or danger.
