Spain's new digital nomad visa is attracting remote workers, but US immigration rules are complicating the path for American applicants.

Spain launched a digital nomad visa to attract remote workers, and it's been popular—but American applicants are running into friction with US immigration rules that weren't designed for location-independent work. The issue centers on how the US defines "employment" and whether working remotely for a US company while physically in Spain triggers visa or tax complications.

Spain's digital nomad visa requires proof of income (typically €2,000–€2,300 monthly) and allows you to live and work remotely in Spain for up to a year, renewable. The visa itself is straightforward. The problem is on the US side: if you're a US citizen or green card holder working remotely for a US employer or clients, you're still subject to US tax on worldwide income, and you must file FBAR and FATCA forms. Some US employers also have policies against employees working from outside the US without explicit approval.
